  Royalty-free music - what does that actually mean?

GEMA free music - information

Royalty-free music primarily means that no fees have to be paid to the collecting society GEMA for its use. However, Royalty-free music titles are not automatically license free or free of charge. Free and GEMA free music you can find here.

The german PRO "GEMA" (Gesellschaft für musikalische Aufführungs- und mechanische Vervielfältigungsrechte - Society for musical performing and mechanical reproduction rights) administers the copyrights of the artists (musicians, composers) who are organized in it. In the case of music subject to GEMA, for example, there is a duty to pay royalties for mechanical reproductions or public performances. These fees (royalties) are in turn paid to the musician (author) on a pro rata basis.

Royalty-free music is music that is not registered with GEMA. In addition, the musician / composer (author) is not a member. Thus for GEMA-free music no levy to GEMA has to be performed.

After a one-time purchase of a license (acquisition of a right of use = licensing), no further costs are incurred by GEMA for the music user / licensee. For example, for mechanical reproduction or for public performance (e.g. trade fairs & events). In addition, the time-consuming filling out of lists (cue sheets) to register used works is no longer necessary. So you save not only money, but also time.

Incidentally, the same applies to other collecting societies outside Germany. In Austria, the equivalent is called AKM free music and in Switzerland SUISA-free music.

FAQ - Royalty free music

Which music is not subject to GEMA?

Music that is outside the jurisdiction of GEMA is free of any GEMA fees. Some types of music that are usually GEMA free include:

  • Music that is not protected by copyright: Pieces of music whose author has been dead for at least 70 years are license-free and therefore not subject to GEMA.
  • Own music: If you have composed your own music titles and are not a member of GEMA yourself, the music is automatically Royalty-free as long as it does not fall under a GEMA publisher or author membership.
  • Music with Creative Commons license: Some artists choose a Creative Commons license for their music, which allows others to use the music as long as they comply with the terms of the license. In this case, the music is not subject to GEMA.

However, it is important to note that there are exceptions and to make sure that you carefully review copyright terms and requirements before using music in any way.
